After this visa expires, you must leave the country for no less than one year. After the one year period has elapsed, you may once again reapply for the H1-B. However, one of the greatest advantages to the H1-B visa is that it allows the professional worker to seek permanent residency, or a "Green Card" for the worker and his/her entire nuclear family while working in the United States.The person must hold a U.S. equivalent 4 years bachelor's or higher degree from an accredited college or university. If the foreign degree is 3 years bachelor's degree,3 years of work experience in same or similar field /occupation can be considered to one year additional education.Visa is valid for three years. However, it may also be extended for an additional three years resulting in a six-year maximum. If you seek a second H1-B because you changed employers, this will not extend your stay under the H1-B for another six years.Section 106 contains special provisions requiring the INS to grant extensions, in one-year increments, past the six-year maximum, in cases of lengthy adjudications.H1B workers, who are the beneficiaries of EB visa petitions or who have submitted applications for adjustment of status, and only if 365 days or more have elapsed since,the filing of an application for a labor certification on their behalf or the filing of an EB visa petition on their behalf.
H2B VISA
The H2B visa is available to employers of foreign unskilled workers not working in the agricultural field. This visa is only available for work that is temporary in nature. he duration of the visa is limited to the employer's need for the temporary workers.The maximum authorized period is one year.
